Do Not Vote Labour!
Further to my last entry regarding Freedom of Speech and the Electoral Finance Act, this is a snippet from an editorial in NZ Herald this morning:

"Bloggers might have little difficulty fitting that definition but they will need to be aware that should their site acquire more than one author or, heaven forbid, make some money in some way from their political observations, the speech patrol could be down on them."

After a little digging, I have come to the conclusion that my blog falls into the category that requires me to put my full name and contact address.

I came to this conclusion for the following reasons:
  • I make direct statements about political parties
  • I make money from the google adsense adverts
  • More than one author exists - comments are able to be left

It seems to me that an email to the commission in the form of a complaint that I do not comply is in order, and to bring a test case for other blogger's is a critical next step.

Although I believe 90% of what Labour does is good for the country, in this one key area I feel they have lost the plot. Unless this act is repealed, I must recommend all visitors to this site do not vote Labour.

In case the commission goon that visits this site does not get it....

Malcom, the google adsense adverts (see to the right of the main page) earn money each time they are clicked.

In a good month, I have enough for a meal out with my wife.

Therefore, I believe it is considered "commercial" as far as the Electoral Finance Act is concerned.

IRD certainly consider it to be "income".

The E F Act stoped anti-democratic practice and the analysis in the press and talk-back-radio / bolg, etc misrepresents this Act. This reflects the high number of idiots and uneducated fascists in the general population. Yes, don't vote Labour, their more neo-liberal than National (fact, look at record, not media / common understanding of).

A lot of my friends and family who use to vote labour are not voting labour in the the next election. This electorial finance bill was the straw that broke the camels back.

Aren't you ok unless you spend/ receive over soemthing like $12,000? But if you're looking for a new party you could always try the Alliance for size. Yes it still exist despite numerous attempts to kill it off.

I agree that this is stupid. After reading today that a 21 year old website dontvotelabour.org.nz has been shut down by the electoral commission I started a facebook group (see link used on my name) to start a quiet protest.

Please put up your hand if you've actually read the bill (the link is below)? I know it is 122 pages of painful reading, but a large amount of the opposition to this bill is based on speculation and hear-say (by no means all of it though, and comments like KR's do need to be addressed).
Furthermore, any attempt to 'prevent the undue influence of wealth on electoral outcomes' is at least a positive step.

Question is Carlos, have YOU read the Bill? Money is but one part of it. The Human Rights Commission, NZ Law Society, and Greenpeace read it and they all made submissions against it.

The Electoral Commission read it, and they shut down www.dontvotelabour.org.nz because it didn't feature the person's home address. The site would have cost maybe $500 at most.

What provisions are you saying they interpreted incorrectly?

This Act applies to ALL speech including spoken speech (bar a few bizarre inconsistent exceptions like exempting text-based blogs but not exempting video-based blogs, YouTube videos, or websites).

It bars people from speaking ONE year out from an election (instead of the three months that is the norm).

Thus, for ONE THIRD of a government's term people are not allowed to freely criticise political parties (having to state your name & address everytime you make a comment critical of the government is NOT free criticism!).

Instead of bickering about whether Karl's entry does or does not qualify for Helen's seal of approval, how about you have a think about how ridiculous it is that a law has been created that means that a poltical rant on a website is actually a grey area in the law.

And as for you Bruce: the Greens are now as neoliberal as the rest of em, and have been complicit in some of the worst compromises of Herr Helen's stormtroopers. I agree with KES, a vote for Alliance is long overdue.

As I understand it, it only applies to advertising. Clause 5(2) expempts editorials, commentaries etc.

I don't get it. The people who complain about this bill try to challenge it by being provocative, in a way which has NOTHING to do with the actual intention of the bill: to stop money from voting.

You complain that Labour has taken away your right to free speech, yet what you say is all rubbish! If you challenged the new law with something actually worth listening to, then perhaps the argument would be more stronger.

And if the problem is solved by fronting up with who you are, then good! Do we live in a society now that people only want to talk behind a curtain? Are you ashamed of your own opinions? Maybe people would think twice about before they spout off ridiculous comments.

In anycase, I would prefer our parlimentarians to be elected on the basis of merit, not their wallets.

EFB is Labour muzzling opposition - simple as that. They take money from "Rich Pricks" too. Then lie about it. "It was a loan..." They take large donations from unions as well. I thought unions were there to look after their members etc. Judging by the wage gap NZ vs Aus and the numbers leaving this country for better pay overseas unions have done sod all to improve things really. Hard to fight the Govt for pay rises etc when you are in bed with them.

Meghan you really don't get it do you. It's not about Herr Helen stopping the money voting. If it were then she wouldn't have spent heaps of taxpayer's money on the pledge card. It's about power and control. These pinkies actually believe that they should be in power and don't care if they manipulate the law to achieve it. This term has seen the worst examples of self serving legislation I've seen and the EF act is there only to serve Labour.
This is corrupt. In a democracy I believe that we all have a right to put our money where our mouth is at election time, even the Exclusive Brethren. I'm not sure that the Unions backing Labour is proper use of members funds as they can't say that they are representing the views of all their members.
